  • Criminal Defense

    Generally, criminal law refers to laws enacted by the federal and state governments that make certain conduct illegal and punishable by imprisonment and/or fines. The legal system consists primarily of two types of cases: civil and criminal. The term "civil case" refers to disputes between individuals regarding their legal obligations and responsibilities towards each other. In contrast, criminal cases are charges brought by prosecutors for violations of criminal statutes.

    Based on their nature and maximum penalty, criminal cases are generally classified as felonies or misdemeanors. New criminal laws are permissible in each state provided they are constitutional. As a result, a crime that is considered a crime in one state may not be considered a crime in another state.

    Felonies involve serious misconduct that is punishable by death or by lengthy imprisonment. There are generally different classes of felonies in state criminal laws, each of which carries a different severity level of punishment. A misdemeanor is a crime that does not constitute a felony. Misdemeanors are offenses for which a maximum sentence of one year in prison is prescribed by law. Smaller offenses, such as traffic tickets and parking tickets, are commonly referred to as infractions.

    This area of the law can be tricky. It essentially encompasses any dispute between two parties, that is not of criminal nature. However, with that said, I am sure you may have seen Wrongful Death suits where the “at fault” party was not Criminally charged, and the family of the victim was able to recover losses from the Civil Suit.
